
ROLLERCADE GEORGE
INDEMNITY, RISK ACKNOWLEDGEMENT AND CONSENT — ONLINE BOOKING
WARNING: ROLLER SKATING AND RELATED ACTIVITIES CARRY AN INHERENT RISK OF INJURY, INCLUDING
SERIOUS INJURY, TO YOURSELF AND OTHERS. BY ACCEPTING BELOW, YOU CONFIRM THAT YOU UNDERSTAND
AND VOLUNTARILY ACCEPT THIS RISK, AND THAT YOU WAIVE CERTAIN LEGAL RIGHTS, FOR YOURSELF AND
EVERY PERSON INCLUDED IN YOUR BOOKING. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE
COMPLETING YOUR BOOKING.
This Indemnity applies to your booking at Rollercade George, situated at Outeniqua Lifestyle Centre, George,
Western Cape (“the Venue”). By ticking “I accept” and completing your booking, you agree to these terms on
your own behalf and on behalf of every other person included in your booking.
1. Parties and Definitions
References in this Indemnity to “Released Parties” mean “ROLLERCADE” (operated by High Ground Trading (Pty)
Ltd), ONE TURN TRADING 187 (PTY) LTD (Registration Number 2003/014566/07), trading as OUTENIQUA
LIFESTYLE CENTRE, and Ancora Group (Pty) Ltd as managing/letting agent, together with all of their respective
partners, members, agents, servants, employees, shareholders, officers, directors, attorneys and contractors,
past, present and future, their respective heirs, legal and personal representatives, successors and assigns, and all
of their respective properties, assets and interests.
2. Waiver, Release and Indemnity
I knowingly and voluntarily waive, release, hold harmless and indemnify the Released Parties from any and all
claims, actions, causes of action, demands, rights, damages, costs, losses, liabilities, expenses, compensation,
controversies, disputes, obligations, debts, dues and liens whatsoever, on account of, or in any way arising out of,
any and all known or unknown, foreseen and unforeseen loss of life or personal injury (whether to myself or a
third party if such damage to the third party is caused by me), loss or damage to property (whether to myself or a
third party if such damage to the third party is caused by me), and the consequences thereof, directly or
indirectly resulting from, incidental to, in connection with, or arising out of participation in roller skating and
related activities at the Venue (“Claims”).
It is my intention that this Indemnity shall apply to all of the Claims without limit and, to the fullest extent
allowed by law, regardless of whether founded, whole or in part, on any negligent (gross or otherwise) or
wrongful act or omission of any of the Released Parties, or by reason of vis major, casus fortuitus, or by any other
cause of whatsoever nature and howsoever arising.
3. Health and Fitness to Participate
I confirm, on behalf of myself and each person included in this booking, that they are in good physical health and
able to tolerate the physical demands of roller skating and related activities, and that they are not aware of any
heart condition, pregnancy, epilepsy, joint, bone or balance condition, or other medical condition that could
make participation unsafe. Any such condition should be disclosed to Rollercade George staff on arrival, before
participating.
4. Equipment Hired or Issued
Roller skates, safety equipment, or other equipment issued at the Venue are accepted as being in good working
order, save for any defect noted in writing to Rollercade George staff before use. If such equipment is damaged
while in the possession or under the control of a person included in this booking (even if used by another party
with consent during the period of hire), that person and/or the person who made the booking remains liable for
all costs of repair or replacement. Should legal proceedings be instituted for the recovery of such costs, the liable
party remains responsible for such legal costs on an attorney-and-own-client scale, including collection
commission.
5. Personal Information (POPIA)
Rollercade George collects and processes the personal information submitted with this booking (including name
and contact details) strictly for purposes of venue safety, emergency response, and administration of this
Indemnity, in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Your acceptance
record (name, booking reference, and date and time of acceptance) is retained as evidence of your consent to
this Indemnity.
6. Photography and Marketing (separate, optional consent)
Rollercade George may wish to use photographs, video or other images taken at the Venue for marketing and
promotional purposes (including social media and print), without payment. This consent is optional and separate
from completing your booking — it must be requested via its own, unticked checkbox, and may be withdrawn at
any time by notifying Rollercade George in writing, without affecting participation.

the mandatory indemnity acceptance in Section 9.
7. Minors Included in This Booking
If this booking includes any person under the age of 18, by accepting these terms you confirm that you are their
parent or legal guardian, or that you have the express authority of their parent or legal guardian to accept these
terms on their behalf, and that you accept these terms for and on behalf of that minor and personally.
8. Venue Rules and Right of Admission
All persons included in this booking agree to comply with posted venue rules and the reasonable instructions of
Rollercade George staff. Rollercade George reserves the right to refuse admission to, or remove from the Venue,
any person whose conduct is considered unsafe, disruptive, or in breach of venue rules, without refund.
9. Acceptance
If any provision of this Indemnity is found to be void, unenforceable, ineffective, or against public policy, that
provision shall be severed and disregarded, and shall not affect the remaining provisions of this Indemnity, which
shall continue in full force and effect.
This Indemnity is governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of
the Magistrate's Court, George, in respect of any dispute arising from this Indemnity, notwithstanding that the
amount in dispute may exceed that Court's normal jurisdiction.
By ticking “I have read, understood, and accept this Indemnity” and completing this booking, I electronically
agree to be bound by this Indemnity, on my own behalf and on behalf of every other person included in this
booking, in terms of the Electronic Communications and Transactions Act 25 of 2002. I understand that my
booking cannot be completed unless I accept these terms.
